Overview
These Terms & Conditions govern the provision of services by Tradie Digital Pros (“Agency”, “we”, “us”) to the client (“Client”, “you”).
By engaging Tradie Digital Pros, you agree to be bound by these terms in full.
Tradie Digital Pros provides two primary service categories. The first is Marketing Services (“Demand”), which focus on building and managing paid advertising systems designed to generate consistent and measurable lead flow. The second is Branding Services (“Authority”), which focus on developing a professional and scalable brand presence across digital and physical assets.
All services are delivered within a clearly defined scope. Any work not expressly agreed to in writing is excluded from the engagement.

Scope of Services
2.1 Marketing Services
Marketing services are designed to establish and manage a structured lead generation system. This is not general marketing support, but a controlled system built around paid advertising, landing pages, and performance tracking. The engagement is delivered in two distinct phases.
The first is the Setup Phase, where campaign infrastructure, landing pages, tracking systems, and initial positioning are established. The second is the Ongoing Management Phase, where campaigns are actively managed, tested, and optimised over time to improve lead quality and cost efficiency.
The Agency will build campaigns, configure tracking, and implement conversion-focused landing pages aligned with the Client’s services. Once live, the system is continuously refined based on real performance data.
All deliverables are strictly limited to the selected service tier. The structure, number of platforms, landing pages, and creative outputs are defined at the start of the engagement and form the boundary of the service.
2.2 Branding Services
Branding services are delivered as structured projects designed to improve how a business presents itself to the market.
This includes the development of visual identity systems, brand positioning, website design, and supporting materials such as proposals, uniforms, signage, and marketing assets. The objective is to create a clear, consistent, and professional presence that supports higher-value work and long-term growth.
Branding engagements are not ongoing retainers unless explicitly agreed. They are delivered as defined projects with specific deliverables, timelines, and revision parameters. The scope of each project is confirmed prior to commencement and forms the basis of delivery.
Service Limitiations
The Agency operates within clearly defined boundaries to ensure quality, consistency, and efficiency.
Only services that are explicitly outlined and agreed to in writing are included in the engagement. Any request that falls outside of this agreed scope will be treated as additional work and may require a separate quote, timeline adjustment, or formal change request.
For clarity, services such as full website rebuilds, ongoing social media management, advanced SEO campaigns, video or photography production, sales team training, and large-scale funnel redevelopment are not included unless specifically stated.
This approach ensures that both parties maintain clarity on what is being delivered and avoids scope creep that can impact performance and timelines.
Fees & Payment
4.1 Marketing Services
Marketing engagements consist of an upfront setup investment and an ongoing monthly retainer.
The setup fee covers the initial strategy alignment, campaign infrastructure, landing page development, and tracking configuration required to launch campaigns correctly. Work does not commence until this payment has been received and all required platform access has been provided.
The monthly retainer covers ongoing optimisation, campaign management, reporting, and iterative improvements. This retainer is billed in advance and is subject to a minimum term of three months from the commencement of the ongoing phase.
If campaigns are paused at the request of the Client during the minimum term, the retainer remains payable in full and the term continues to run. Pausing campaigns does not pause billing. The Agency is not responsible for any performance fluctuations that occur as a result of paused campaigns.
All third-party costs, including advertising spend, software subscriptions, hosting, and CRM platforms, are the responsibility of the Client and are not included in Agency fees.
4.2 Branding Services
Branding services are priced on a project basis and require payment prior to commencement, unless otherwise agreed.
Depending on the scope of the project, payment may be structured as an upfront fee or split into staged payments. Work will not begin until the agreed payment terms have been satisfied.
Project timelines are dependent on the Client providing timely feedback, approvals, and required information. Delays in communication or decision-making may result in adjusted timelines without liability to the Agency.
Performance + Results
The Agency provides systems, strategy, and execution designed to improve marketing performance. However, no guarantees are made in relation to specific results, including revenue, profit, or return on investment.
Marketing performance is influenced by a range of factors outside the Agency’s control. These include market demand, competition, pricing, the strength of the Client’s offer, budget allocation, and the effectiveness of the Client’s internal sales process.
While key performance indicators such as cost per lead and conversion rates may be used as benchmarks, they are used for optimisation purposes only and do not constitute guarantees.
The Agency is responsible for generating and improving lead flow. The Client is solely responsible for handling enquiries, following up leads, and converting those leads into paying customers.
Client Responsibilities
The success of the engagement relies on active collaboration between the Agency and the Client.
The Client is responsible for providing all necessary access to platforms, systems, and accounts required for the delivery of services. This includes advertising platforms, analytics tools, CRM systems, and website infrastructure.
The Client must also provide timely feedback, approvals, and information when requested. As a general guideline, responses should be provided within five business days. Failure to do so may result in delays, reduced performance, or the Agency proceeding based on its professional judgement.
The Client is also responsible for ensuring that their business operations, offer, and service delivery systems are functional and capable of handling incoming leads.
Platform Access + Data
To deliver services effectively, the Agency requires appropriate access to relevant platforms.
All access is requested securely and is used solely for the purpose of campaign setup, management, and reporting. The Agency does not request or store personal passwords unless explicitly required and shared through secure methods.
Access is restricted to authorised personnel and will be revoked upon termination of services.
The Agency does not sell, share, or distribute Client data under any circumstances. However, the Agency is not responsible for data inaccuracies, platform errors, or attribution limitations that exist within third-party systems.
Intellectual Property
All work produced by the Agency remains its property until payment has been made in full.
Upon full payment, ownership of branding deliverables is transferred to the Client. This includes logos, visual identity systems, and agreed design assets.
Marketing assets, including campaigns, ad structures, and optimisation frameworks, remain connected to the systems in which they are built unless otherwise agreed.
The Agency reserves the right to use non-sensitive work for portfolio and promotional purposes.
Approvals & Delivery
All deliverables provided during the engagement are subject to review by the Client.
If no feedback or requested revisions are provided within five business days of delivery, the work will be deemed accepted.
The Agency may then proceed with implementation or continue to the next stage of the engagement.
Ongoing marketing work is iterative by nature and evolves over time based on performance data. As such, individual changes or adjustments do not constitute final deliverables in the same way as fixed project work.
Change Requests
Any request that falls outside the agreed scope of work must be submitted in writing.
The Agency will assess the impact of the request on cost, timeline, and resources. No additional work will be carried out without written approval from the Client.
This process ensures clarity, protects both parties, and maintains the integrity of the original engagement.
Suspension + Termination
The Agency reserves the right to suspend services if the Client fails to meet payment obligations, does not provide required access, or breaches these terms.
Upon suspension, campaigns may be paused and access to systems may be restricted.
If the engagement is terminated, all outstanding invoices become immediately payable. The Agency is not responsible for any loss of performance or disruption resulting from the termination of services.
Liability
To the maximum extent permitted by law, the Agency is not liable for any indirect, incidental, or consequential losses, including loss of revenue, profit, or business opportunity.
The Agency provides professional services based on experience and best practice, but does not control external variables such as market conditions, platform performance, or Client-side execution.
General
These Terms & Conditions apply to all services provided by Tradie Digital Pros unless otherwise agreed in writing.
Any variation to these terms must be documented and approved by both parties.
If any provision of these terms is found to be unenforceable, the remaining provisions will continue in full effect.
Acceptance
By engaging Tradie Digital Pros, you confirm that you have read, understood, and agreed to these Terms & Conditions.
You acknowledge that the engagement is based on a defined scope, that results are not guaranteed, and that both parties have responsibilities in achieving successful outcomes.
